A jury ruled on Monday that Elon Musk missed the 3-year deadline to file a lawsuit against OpenAI and two of its cofounders, CEO Sam Altman and president Greg Brockman, and therefore dismissed his lawsuit accusing the AI Lab of breach of contract.
Musk alleged in the suit that OpenAI, which he helped found before leaving in 2018, abandoned its original nonprofit mission to maximize profits and deceived him into donating $38 million under the pretense that it was developing artificial general intelligence for the benefit of humanity.
In its decision, the jury said Musk knew about OpenAI’s desire to become public by as far back as 2021. Judge Yvonne Gonzalez Rogers agreed with the Jury and dismissed the case.
The lawsuit was the latest chapter in the rivalry between the SpaceX owner and Tesla CEO. Musk sued OpenAI, Altman and Brockman -- later adding Microsoft -- in 2024, stating that the leaders of OpenAI deceived him by first accepting his early donations and then trying to form a monopoly with Microsoft after gaining financial backing from the tech giant in 2021. He argued that he co-founded the AI lab as an open source alternative to tech giants such as Google with their proprietary technology. He sought $150 billion in damages, the removal of Altman and Brockman from OpenAI’s leadership and the dismantling of OpenAI’s for-profit entity.
While some argued that Musk’s lawsuit was self-serving because his company xAI’s AI generative AI model, Grok, directly competes with OpenAI’s ChatGPT. The ruling is likely to significantly bolster OpenAI as it prepares for an IPO expected later this year. A swift end to the three-week trial is what it could have hoped for.
“This victory of this particular hurdle, which is non-trivial, is now out of the way,” said Michael Bennett, a lawyer and associate vice chancellor for data science and AI strategy at the University of Illinois Chicago.
While Musk is planning SpaceX's own IPO for next month, Bennett said it is unlikely this ruling will affect how that turns out, but it might raise concerns in financial circles, including among investors.
“Those who are sensitive to public sentiment and investor sentiment may be a little worried now,” Bennett said. “It’s a little bit of egg on the face for Musk and strategy.”
Bennett said even law students would have been able to tell that the statute of limitations had run out, and so filing a lawsuit was a bad idea.
“I can imagine some observers and some investors wondering about the wisdom of the move, but given the potential upside and evaluations, I'd be surprised if there's a huge dent in enthusiasm,” Bennett continued.
Moreover, it is also unlikely that the court decisions will sway enterprise customers to switch from ChatGPT to Grok. He said most organizations are looking at how the models measure against competitors. Moreover, those who support xAI or OpenAI are already in their camps.
“I'd be surprised if many people all of a sudden change their minds about either organization or either figurehead based on the result of this legal controversy,” Bennett said.
